California DOJ releases opinion on daily fantasy sports

The California Department of Justice has issued a legal opinion on the subject of daily fantasy sports. This release is in compliance with Government Code section 12519, which mandates that the Department provide formal legal opinions on qualifying issues upon request from a member of the legislature. The current opinion was requested by Assemblymember Tom Lackey.

The Department’s role in this matter was to clarify existing law rather than to create or modify legislation. Any changes to the law remain under the jurisdiction of the California Legislature and its voters.
