Timothy Lee, Senior Vice President of Legal and Public Affairs at the Center for Individual Freedom, has expressed concerns about foreign interests exploiting American courts through third-party litigation funding. He described this as a threat to justice in an op-ed for The Washington Times.

“We’re witnessing a legal dispute that raises troubling issues of foreign intervention in domestic courts and third-party litigation funding,” said Lee. “At the heart of that operation is Australian mining mogul Andrew Forrest, whose company, Fortescue Metals Group, competes with Exxon Mobil in the low-carbon and energy transition space. If true, that kind of state-sponsored defamation should trigger alarm, especially when it targets private-sector solutions to real environmental problems. America cannot allow foreign money and the self-interest behind it to hijack our justice system. Those with the power to remedy the situation must act accordingly.”

According to Reuters, third-party litigation funding in the United States has experienced rapid growth. This trend raises questions about the influence of outside financiers, including foreign investors, on American legal proceedings. Legal experts have warned that these financial arrangements may impact the objectivity and transparency of lawsuits, fueling ongoing policy debates about whether additional regulations are needed to protect the integrity of the court system.

The American Security Project has said that foreign third-party litigation financing has become a national security concern. Foreign entities are increasingly able to influence U.S. legal outcomes by funding lawsuits for strategic, political, or economic advantage. The lack of disclosure requirements regarding these funding sources heightens the risk of covert interference in the American judicial process, prompting recommendations for improved oversight and transparency.

According to Plastics Litigation Tracker, Exxon Mobil and other major plastics producers have been named in an increasing number of lawsuits nationwide. These cases often involve allegations related to environmental harm, waste, or misleading public claims. The lawsuits are tracked across multiple states and reflect growing legal challenges facing the plastics and petrochemical industry from both government entities and advocacy groups.
