California Attorney General Rob Bonta and Secretary of State Shirley N. Weber announced the California Superior Court’s decision to invalidate Measure A in Fresno County. The measure sought to amend the county’s charter, moving elections for district attorney and sheriff from the presidential cycle to the gubernatorial cycle.
Attorney General Bonta and Secretary of State Weber had filed a lawsuit against Measure A last year. They argued that it conflicted with state law, which mandates these elections be held during the presidential election cycle due to traditionally higher voter turnout.
The Superior Court ruled that Measure A violates California’s election law and permanently blocked its enforcement in Fresno County. “There is nothing more fundamental to American democracy than the right to vote and make your voice heard,” stated Attorney General Bonta. He emphasized that moving these elections could have undermined voter participation by shifting them to off years with typically lower turnout.
Secretary of State Weber added, “Our democracy works best when more citizens can participate in our elections.” She noted that the ruling ensures more voices are heard in Fresno County’s elections for district attorney and sheriff.
The court order is publicly available for review.
