Governor Gavin Newsom has voiced his disappointment over a recent decision by the Ninth Circuit, which permits President Trump to maintain control over the California National Guard temporarily. However, Newsom welcomed the court’s rejection of Trump’s assertion that he could federalize the National Guard without judicial oversight.

The Ninth Circuit ruled against what it described as Trump’s “sweeping claim” to federalize the National Guard for any reason and avoid judicial scrutiny. This decision is seen as an important check on presidential power, reinforcing that no president is above the law.

In response to the ruling, Governor Newsom stated: “The court rightly rejected Trump’s claim that he can do whatever he wants with the National Guard and not have to explain himself to a court. The President is not a king and is not above the law. We will press forward with our challenge to President Trump’s authoritarian use of U.S. military soldiers against citizens.”

Attorney General Rob Bonta stands with Governor Newsom in their commitment to hold President Trump accountable for his actions, which they argue violate federal law by using military forces for domestic law enforcement.

The case continues as both state leaders push back against what they describe as an “authoritarian” use of military power by the President.
