California Attorney General Rob Bonta has released a report on the officer-involved shooting of Christopher Mercurio in Valencia, California. The incident occurred on January 11, 2023, and involved a deputy from the Los Angeles Sheriff's Department (LASD). This report is part of the California Department of Justice's (DOJ) efforts to ensure transparency and accountability in law enforcement practices.
The investigation concluded that criminal charges were not appropriate. "We recognize the considerable challenges and difficulties faced by all those impacted, including Mr. Mercurio’s family, the law enforcement agencies involved, and the community as a whole," said Attorney General Bonta. "The California Department of Justice aims to partner with law enforcement to build a just and equitable legal environment, ensuring that the rule of law is upheld, and justice is accessible to everyone."
On January 11, 2023, at approximately 10:58 PM, an LASD deputy responded to a trespassing call at Macy’s department store in Valencia Town Center. The deputy encountered Mr. Mercurio who refused to leave and struck Deputy Gonzalez in the head. Despite commands to step back, Mr. Mercurio continued advancing towards Deputy Gonzalez. The deputy then fired two shots at Mr. Mercurio, resulting in his death.
Under Assembly Bill 1506 (AB 1506), which mandates DOJ investigations into officer-involved shootings resulting in unarmed civilian deaths in California, DOJ found insufficient evidence to prove beyond reasonable doubt that the deputy acted without intent to defend themselves or others from imminent risk of death or serious injury.
The DOJ made three policy recommendations for LASD following this incident:
1. Expand de-escalation policies with specific guidelines and training for deputies.
2. Provide guidance on identifying individuals with mental health conditions through various factors such as self-reporting or direct observations.
3. Offer refresher training on post-shooting procedures emphasizing communication protocols.
