Sacramento, Calif. - Today, the California Court of Appeal Third District upheld the Sacramento Superior Court’s ruling permitting Assemblymember Vince Fong to appear on the same March 5, 2024, ballot as a candidate for both the 32nd Assembly District and the 20th Congressional District.
In response to the court's decision, California Secretary of State Shirley N. Weber, Ph.D., expressed her disappointment, stating, "We disagree with and are disappointed with the Court of Appeals ruling. The opinion runs contrary to California history and practice. Both the Court of Appeals and trial court recognize this ruling leaves the door open to chaos, gamesmanship, and voter disenfranchisement, and disadvantages other candidates."
Dr. Weber further added, "My office sought to avoid such problems through this litigation. This ruling highlights the need for legislative attention. We are carefully considering all our options."
The case has raised concerns about the potential impact on the electoral process and the fairness of allowing a candidate to run for multiple offices simultaneously. The Secretary of State's remarks emphasize the importance of addressing these issues to uphold the integrity of the electoral system in California.
