California enacts law targeting racial disparities in maternal mortality

California Attorney General Rob Bonta has responded to the Governor's signing of Assembly Bill (AB) 2319, a measure aimed at reducing maternal mortality rates among Black women and other pregnant persons of color. The bill seeks to ensure the effective implementation of Senate Bill 464 (SB 464), known as the California Dignity in Pregnancy and Childbirth Act of 2019. AB 2319 is co-sponsored by Attorney General Bonta and authored by Assemblymember Lori Wilson, Dr. Akilah Weber, and the California Legislative Black Caucus.

Attorney General Bonta emphasized the urgency of addressing maternal mortality rates in the United States, particularly among communities of color. "It is painfully clear that we are not doing nearly enough for our nation’s mothers and children, especially those of color, as our country has the highest maternal mortality rate among developed countries," he stated. "No mother should ever have to fear for their health or the well-being of their child."

Assemblymember Dr. Akilah Weber highlighted the importance of listening to pregnant individuals' concerns during childbirth. “When giving birth, individuals are asked to listen to their bodies and to share that information with the medical professionals caring for them,” she said. “Unfortunately, concerns surrounding discomfort or pain are not taken as seriously when they are made by persons of color, specifically black persons.”

Assemblymember Lori Wilson expressed gratitude towards Governor Newsom for signing AB 2319 and acknowledged Attorney General Bonta's role in ensuring compliance and transparency. "I am deeply grateful to Governor Newsom for signing AB 2319, a bill that will help save lives by addressing the alarming racial disparities in maternal healthcare outcomes," she said.

The United States holds the highest maternal mortality rate among developed nations, with communities of color disproportionately affected. In California, Black women represent 5% of those pregnant but account for 21% of pregnancy-related deaths across all income levels. Implicit bias among healthcare providers is identified as a significant factor contributing to this disparity.

The new legislation builds on efforts by the California Department of Justice to ensure healthcare facilities comply with SB 464. This includes mandatory evidence-based implicit bias training for all health professionals involved in perinatal care.

A press conference was held on February 12, 2024, by Attorney General Bonta and members of the California Legislative Black Caucus to emphasize the importance of this legislation.
