California Attorney General Rob Bonta has issued a new law enforcement bulletin detailing the legal changes under Proposition 36. Approved by voters on November 5, 2024, the proposition, named "The Homelessness, Drug Addiction, and Theft Reduction Act," will be effective from December 18, 2024.

Attorney General Bonta emphasized the importance of collaboration in addressing organized retail crime. “Ultimately, our success in combating organized retail crime hinges on our ability to work together, innovate, and remain steadfast in our commitment to protecting our neighborhoods and businesses,” said Bonta. He urged for collective efforts to ensure community safety through new legislation.

Proposition 36 revises existing laws and introduces significant charges and enhancements concerning theft, property damage, and drug-related crimes. The adjustments include establishing new felony theft and drug crimes aimed at repeat offenders. It also removes the eligibility for certain sentences to be served in county jails instead of state prisons as per Penal Code section 1170(h). Additionally, it aligns penalties for fentanyl-related offenses with those for other similar controlled substances.
