The California Department of Justice has released a report concerning the officer-involved shooting of Austin Flores, which occurred in Fresno, California, on May 19, 2022. The incident involved officers from the Fresno Police Department and was investigated under Assembly Bill 1506 (AB 1506), which mandates inquiries into officer-involved shootings resulting in the death of unarmed civilians.
The report is part of ongoing efforts by the California Department of Justice to ensure transparency and accountability within law enforcement practices. It provides an analysis of the incident and details DOJ's findings. After completing their investigation, DOJ determined that criminal charges were not appropriate in this case.
Attorney General Rob Bonta commented on the situation, stating: “The tragic loss of life in this incident profoundly affects the entire state of California. We recognize the considerable challenges and difficulties faced by all those impacted, including Mr. Flores’s family, the law enforcement agencies involved, and the community at large."
Bonta emphasized that "the California Department of Justice is dedicated to collaborating with all law enforcement entities to maintain a legal system that is fair, transparent, and accountable to every Californian." He further stated: "We are committed to building trust and integrity within our justice system, ensuring that the rights and dignity of all individuals are upheld and safeguarded.”
According to the report, on May 19, 2022, officers attempted to serve a restraining order at a relative's residence where they encountered Mr. Flores. He allegedly brandished what appeared to be a firearm at an officer. In response, an officer fired nine rounds at Mr. Flores who later died from his injuries. The weapon turned out to be a replica.
The DOJ concluded that there was insufficient evidence for criminal prosecution because it could not be proven beyond reasonable doubt that officers acted without intent to defend themselves or others from perceived imminent threats.
