California Attorney General Rob Bonta, along with 13 other attorneys general, has filed a lawsuit against the Trump Administration. The legal action challenges Elon Musk's exercise of power, which they claim is unconstitutional. The lawsuit contends that Musk, who holds a position in the Department of Government Efficiency (DOGE), exercises authority akin to that of a "principal officer of the United States." Such a role requires creation by Congress and confirmation by the Senate.
Attorney General Bonta stated, "Elon Musk does not occupy a position that Congress created or that the Senate confirmed — Mr. Musk occupies a position the President made up. This is a clear and dangerous effort to bypass the nomination and confirmation process required under the Constitution." He further described DOGE's actions as causing chaos and distrust among Americans.
The lawsuit argues that Musk's actions have disrupted federal agencies, accessed sensitive data, and affected state and local governments' operations. It also claims that his influence has jeopardized billions in federal funding critical for services like law enforcement, healthcare, and education.
Joining Bonta in this legal challenge are attorneys general from New Mexico, Arizona, Michigan, Connecticut, Hawaii, Maryland, Massachusetts, Minnesota, Nevada, Oregon, Rhode Island, Vermont, and Washington.
