California Attorney General Rob Bonta, Governor Gavin Newsom, and California Department of Housing and Community Development (HCD) Director Gustavo Velasquez have reached an agreement with the city of Malibu to ensure compliance with the state's Housing Element Law. This settlement will enable Malibu to adopt a housing plan by September 23, 2024, allowing for the development of 79 housing units, 47 of which must be affordable to low- and very low-income households.
Attorney General Rob Bonta emphasized the importance of this settlement, stating, "Our housing laws are not optional; they apply to all cities and counties in California." Governor Gavin Newsom echoed this sentiment, asserting that "everyone must build their fair share of housing."
HCD Director Gustavo Velasquez highlighted the significance of the agreement, stating, “Malibu is a community that holds both tremendous need for affordable housing, and tremendous opportunity." Malibu Mayor Steve Uhring also expressed dedication to fulfilling obligations, saying, “We understand the importance of adhering to the State’s housing element law and are dedicated to fulfilling our obligations.”
The housing element update process is crucial, as it includes an assessment of housing needs, an inventory of resources, and a program to implement the policies and objectives of the housing element. The agreement with Malibu ensures an expedited timeline for compliance and public participation in the process.
Malibu has agreed not to deny certain low-, very low-, and moderate-income housing development projects until a compliant housing element is adopted. Failure to comply could result in monetary penalties for the city.
The settlement, in the form of a proposed stipulated judgment, is subject to court approval and can be accessed for further details regarding the terms.
