MONTEREY COUNTY: Food Facility Health Permit Revoked For Repeated Violations of COVID-19 Orders

Monterey County issued the following announcement on Dec 26.

The Monterey County Health Department’s Environmental Health Bureau (EHB) announced today the health permit revocation of Aloha Coffee and Café, located at 1098 Del Monte Ave, Ste A, Monterey, owned by Richard Dunnick, charged with multiple violations of the county Mask Ordinance, No. 5336 and California Health and Safety Code for retail food facilities. Multiple violation notices regarding the proper use of facemasks by himself, employees, and patrons of his establishment were issued. After repeated failures to adhere to face mask requirements, and brazen operation while the health permit was suspended, Mr. Dunnick’s facility permit was revoked on Dec 23, 2020. A revocation hearing was held on Dec 16, 2020 resulted in the validation of the health permit revocation by an administrative law judge.

On July 28, 2020, the Monterey County Board of Supervisors issued an urgency ordinance that directs all food facilities to ensure that staff wear masks and require customers to comply as well. The urgency ordinance provides that violations of a local health officer order, state public health officer order, or executive order of the Governor of the State of California, requiring the wearing of masks or facial coverings in the unincorporated area during the COVID-19 pandemic, are subject to an administrative citation process and fines.

The EHB also oversees health and safety requirements of retail food facility operations in the county enforcing state and local health codes, including but not limited to the California Code for Retail Food Establishments, also known as CalCode. EHB and has and continues to work with local food businesses during the pandemic to develop a consistent approach to doing business within the ordinance and state COVID-19 requirements.

“We take protection of public health very seriously, as this is our primary duty as Environmental Health Specialists. The EHB makes every effort to educate all and will revoke health permits of businesses that are public health nuisances who choose to ignore efforts to address threats to public health”, said Ric Encarnacion, Assistant Bureau Chief of EHB.
