Governor Gavin Newsom has granted pardons to five veterans who served honorably in the U.S. Armed Forces, according to a recent announcement made on Veterans Day. In addition, he has initiated proceedings for a posthumous pardon for Sergeant Richard Allen Penry, an Army veteran and Medal of Honor recipient.
Sergeant Penry, born in Petaluma, served during the Vietnam War and was recognized by President Nixon in 1971 for his "extraordinary heroism at the risk of his own life." After returning from service, Penry faced challenges reintegrating into civilian life due to limited resources and understanding of PTSD at that time. His subsequent struggles with substance use led to drug-related convictions. The process for his pardon requires approval from the California Supreme Court because of multiple felony convictions.
Governor Newsom emphasizes that executive clemency is a crucial element of the criminal justice system that promotes accountability and rehabilitation while addressing unjust legal outcomes and health needs of incarcerated individuals with high medical risks. Clemency acknowledges personal growth and responsibility after conviction but does not absolve or reduce the harm caused.
A pardon can alleviate barriers to employment and public service, restore civic rights, and prevent consequences like deportation or family separation. However, it does not erase a conviction.
The Governor considers several factors when reviewing clemency applications: the applicant’s conduct since their offense, whether granting clemency serves justice interests, and its impact on crime victims and communities.
